TERMS OF SERVICE

Welcome to Operation WarriorFit ("OWF," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at operationwarriorfit.org (the "Site") and all related services, programs, and events offered by Operation WarriorFit, a registered 501(c)(3) nonprofit organization.
By accessing our Site, creating an account, applying for race entries, registering for events, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.
Important Notice
Please read these Terms carefully, including our Event Attendance Policy and Code of Conduct. Violation of these policies may result in suspension or termination of your account and access to OWF programs.
1. ELIGIBILITY
To participate in OWF programs and services, you must:
- Be at least 18 years of age (or have parental/guardian consent for minors participating in applicable events)
- Be a veteran, active duty service member, reservist, National Guard member, or first responder (firefighter, police officer, EMT/paramedic, 911 dispatcher), OR be a family member of an eligible participant where permitted
- Provide accurate and truthful information in all applications and registrations
- Be able to verify your military service or first responder status when requested
- Not have been previously banned or suspended from OWF programs
OWF reserves the right to verify eligibility at any time and to deny or revoke participation if false or misleading information is provided.
2. ACCOUNT REGISTRATION
When you create an account or submit an application through our Site, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your information to keep it accurate and current
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You may not share your account credentials with others or allow others to access your account. OWF reserves the right to suspend or terminate accounts that violate these Terms.
3. EVENT ATTENDANCE POLICY
No-Show Policy
Operation WarriorFit provides race entries at no cost to eligible participants through the generosity of our donors and partners. Each entry represents a significant investment in our mission. When participants fail to attend events without proper notice, it wastes resources and takes opportunities away from other warriors who could have participated.
A "no-show" is defined as failing to attend a registered event without providing at least 72 hours advance notice to OWF.
First Offense
60-day suspension from applying to or participating in any OWF events. A written warning will be issued to your registered email address.
Second Offense
90-day suspension from applying to or participating in any OWF events. A final warning will be issued.
Third Offense
Permanent account termination. You will no longer be eligible to participate in any OWF programs or events. Appeals may be submitted in writing after 12 months.
Excused Absences
We understand that emergencies happen. The following situations may qualify for an excused absence and will not count toward the no-show policy:
- Military deployment or orders (documentation required)
- Medical emergency (documentation may be requested)
- Family emergency (death, serious illness of immediate family member)
- Natural disaster or severe weather preventing travel
- Other extenuating circumstances approved by OWF leadership
To request an excused absence, contact us at Contact.Us@OperationWarriorFit.com as soon as possible, and no later than 24 hours after the event.
Cancellation Policy
If you need to cancel your participation in an event, please notify us at least 72 hours (3 days) before the event start time. This allows us to potentially reassign your entry to another warrior. Cancellations made with proper notice will not count as a no-show.
4. CODE OF CONDUCT
As a participant in OWF programs, you represent our organization and the broader community of veterans and first responders. You agree to:
- Treat all participants, volunteers, staff, and event personnel with respect and dignity
- Refrain from harassment, discrimination, or abusive behavior of any kind
- Follow all rules and guidelines set by event organizers and race officials
- Not engage in any illegal activity before, during, or after events
- Not misrepresent your military service, first responder status, or affiliation with OWF
- Not use OWF's name, logo, or affiliation for personal gain without written permission
- Represent yourself and OWF positively in all interactions, including on social media
- Report any safety concerns or violations to OWF staff immediately
Violations of this Code of Conduct may result in immediate removal from events, suspension, or permanent ban from OWF programs at our sole discretion.
5. ACCEPTABLE USE OF THE SITE
When using our Site, you agree NOT to:
- Violate any applicable laws, regulations, or these Terms
- Submit false, misleading, or fraudulent information
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to gain unauthorized access to any part of the Site or its systems
- Use automated systems, bots, or scripts to access the Site
- Interfere with or disrupt the Site's functionality or servers
- Transmit viruses, malware, or other harmful code
- Collect or harvest personal information of other users
- Use the Site for any commercial purpose without our written consent
- Post or transmit content that is defamatory, obscene, threatening, or otherwise objectionable
- Infringe on the intellectual property rights of others
6. USER CONTENT
By submitting content to our Site (including but not limited to stories, photos, testimonials, and comments), you:
- Grant OWF a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, modify, and distribute your content for promotional and operational purposes
- Represent that you own or have the rights to the content you submit
- Understand that your content may be used on our website, social media, marketing materials, and other communications
- Waive any claims against OWF related to the use of your submitted content
OWF reserves the right to remove any user content at our discretion without notice.
7. INTELLECTUAL PROPERTY
All content on the Site, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of Operation WarriorFit or its licensors and is protected by copyright, trademark, and other intellectual property laws.
The OWF name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Operation WarriorFit. You may not use these marks without our prior written permission.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our express written consent.
8. DONATIONS
All donations to Operation WarriorFit are voluntary and non-refundable. OWF is a 501(c)(3) nonprofit organization (EIN: 33-2673785), and donations may be tax-deductible to the extent permitted by law. Consult your tax advisor for specific guidance.
Donation allocations shown on our website are general guidelines and may vary based on organizational needs. OWF reserves the right to allocate funds in the manner it deems most beneficial to fulfilling its mission.
9. DISCLAIMER OF WARRANTIES
THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. OWF DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee that any race entries or event participation will be available.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OPERATION WARRIORFIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN OWF PROGRAMS.
OWF is not responsible for any injuries, accidents, or damages that occur during events. Participants assume all risks associated with participation in athletic events and agree to sign any required waivers from event organizers.
11. ASSUMPTION OF RISK
Participation in athletic events, including but not limited to running races, obstacle course races, triathlons, and other endurance events, involves inherent risks including but not limited to:
- Physical injury, including serious injury or death
- Property damage or loss
- Exposure to weather conditions
- Contact with other participants, spectators, or equipment
- Course hazards and obstacles
By participating in OWF programs, you acknowledge these risks and assume full responsibility for your participation. You represent that you are physically capable of participating in your chosen events and have consulted with a physician if necessary.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Operation WarriorFit and its officers, directors, employees, volunteers, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Site or participation in OWF programs
- Your violation of these Terms
- Your violation of any rights of another party
- Any content you submit to the Site
13. THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites, services, or resources. These links are provided for convenience only, and OWF does not endorse or assume responsibility for any third-party content, products, or services.
Your interactions with third-party websites and services are solely between you and the third party. We encourage you to review the terms and privacy policies of any third-party sites you visit.
14. PRIVACY
Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to our collection and use of information as described in the Privacy Policy.
15. MODIFICATIONS TO TERMS
OWF reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Site and updating the "Last Updated" date. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
We encourage you to review these Terms periodically for any updates.
16. TERMINATION
OWF may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms
- Violation of the Event Attendance Policy (no-show policy)
- Violation of the Code of Conduct
- Fraudulent or misleading information
- Request by law enforcement or government agency
- Extended periods of inactivity
Upon termination, your right to use the Site and participate in OWF programs will immediately cease.
17. DISPUTE RESOLUTION
Any disputes arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through informal negotiation. If informal resolution is not successful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
You agree to waive any right to a jury trial or to participate in a class action lawsuit against OWF.
18. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Henderson County, North Carolina.
19. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
20. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Site, constitute the entire agreement between you and Operation WarriorFit regarding your use of the Site and supersede all prior agreements and understandings.
